Do you think debtors could be given sentences that do not involve incarceration? Answer from Suzanne DiVito Simonelli: Yes, I believe a debtor who is financially able to pay the debt and a penalty for late payment might warrant a sentence that did not involve incarceration. Also, if there is the ability to garnish wages until the debt and related penalties for non-payment are fulfilled a debtor might also avoid a jail sentence.
