Article XIIIB of the California Constitution and state law require that each public agency adopt an "appropriations limit," (also called a "Gann limit") which limits the "proceeds of taxes" that the public agency may receive to the amount adopted by the public agency. "Proceeds of taxes" generally means all taxes and subventions received by that public agency, subject to specific constitutional exceptions. Proceeds of taxes received by the public agency in excess of the limit must be returned.

At the time the City of Jurupa Valley was incorporated, the provisional appropriations limit, was set by the Riverside County Local Agency Formation Commission ("LAFCO") at $27,914,961 and enacted as part of the incorporation of the City of Jurupa Valley by the voters in 2011.

Under the provisions of Government Code Section 56812, newly incorporated cities operate under the provisional appropriations limit set by LAFCO as a condition of incorporation until that limit is adjusted as permitted by law. Newly incorporated cities are then required to determine a permanent appropriation limit to be submitted to the voters at the first election after the first full fiscal year of incorporation. This November 2012 election is the first election after the City's first fiscal year. State law requires the permanent appropriations limit to be computed by adjusting the provisional limit for population increases or decreases and actual proceeds of taxes received.

The proposed permanent limit in Measure "P" is $28,967,355 which is $1,052,394 greater than the provisional limit adopted by the voters in 2011 at incorporation. The appropriations limit does not mean the City will spend this much money, only that this is the maximum amount of the proceeds of taxes it may receive. The permanent limit will be adjusted annually using factors for changes in population and changes in income as provided in state law.

A "yes" vote on Measure "P" would approve the appropriations limit for the City of Jurupa Valley at $28,967,355. A "no" vote means the appropriation limit is not adopted and the provisional appropriations limit set by LAFCO and adopted as part of the incorporation by the voters remains in effect unless and until a permanent appropriations limit is adopted by the voters.

Measure "P" will be adopted if it is approved by a majority of the voters voting on the measure.
