Article XIIB and state law require that each public agency adopt an "appropriations limit," (also called a "Gann limit") which limits the "proceeds of taxes" that the public agency may receive to the amount adopted by the public agency. "Proceeds of taxes" generally means all taxes and subventions received by that public agency, subject to specific constitutional exceptions. Proceeds of taxes received by the public agency in excess of the limit must be returned.

At the time the City of Eastvale was incorporated, the provisional appropriations limit, was set by LAFCO at $13,938,809 and enacted as part of the incorporation of the City of Eastvale by the voters on October 1, 2010. The appropriations limit for fiscal year 2011-2012 was set at $14,547,298 pursuant to resolution on June 22, 2011 due to population and consumer price index.

Under the provisions of Government Code Section 56812, newly incorporated cities operate under the provisional appropriations limit set by LAFCO as a condition of incorporation until that limit is adjusted as permitted by law. Newly incorporated cities are then required to determine a permanent appropriation limit to be submitted to the voters at the first election after the first full fiscal year of incorporation. This November 6, 2012 election is the first election after the City's first fiscal year. State law requires the permanent limit to be computed by adjusting the provisional limit for population increases or decreases and actual proceeds of taxes received.

The proposed permanent limit in Measure "BB" is $15,518,412 which is $1,579,603 more than the provisional limit adopted by the voters on October 1, 2010 and $971,114 more than the provisional appropriations limit set for fiscal year 2011-2012.

The permanent limit will be adjusted annually using factors for changes in population and change in income as provided in state law. If Measure "BB" is not adopted, the provisional limit will remain in place unless and until a permanent limit is adopted by the voters.
