Do the Citizens of the CITY OF MORGAN HILL, CALIFORNIA ordain that Ordinance 835 N.S. Section II A. 2, regarding the portion zoned PUD-Commercial of the Morgan Hill Business Park, specifically the existing Cochrane Plaza shopping center, be amended to remove the prohibition on grocery supermarkets and to add grocery supermarkets as a permitted use?

Impartial Analysis from the City Attorney
The Cochrane Plaza Shopping Center (Center) is located in the Morgan Hill Business Ranch at the southeast corner of Cochrane Road and Sutter Boulevard. The Center is bordered by U.S. 101 to the east and Jarvis Drive to the south. The Center is subject to an existing Planned Unit Development (PUD) Commercial zoning which specifically excludes grocery supermarkets as a permitted use (Restriction). The Restriction is the result of the passage of an Initiative vote held on September 22, 1987 aimed at allowing a shopping center to be developed on a portion of the Morgan Hill Business Ranch and at controlling the mix of businesses at the Center that are available to serve residents.

Measure H would amend the City General Plan Land Use category and commercial services standard of the Morgan Hill Business Park PUD to permit grocery supermarkets within the Center. Permitted uses and development criteria for the Center currently include retail stores (excluding grocery supermarkets) and wholesale business, restaurants, offices, professional offices, financial services, personal services, services agencies, banks and lending institutions, coffee shops, cocktail lounges, private educational facilities, recreation, amusement and entertainment facilities, wine tasting, parking garages, day care facilities and nursery schools; with height, area, lot depth, width, coverage, setbacks, parking, loading and sign requirements as detailed in the existing PUD.

The ordinance may be repealed or amended only by a majority of the voters of the City.

Arguments For Measure H Arguments Against Measure H
Measure H would expand the allowed uses at the Cochrane Plaza Shopping Center to allow grocery supermarkets. The zoning for this Shopping Center was established by voter initiative (Measure B) on September 22, 1987, and specifically excluded a grocery supermarket. Because the Target Store will soon be moving to a new, larger store nearby, the owner of the Shopping Center has asked that the allowed uses be expanded to provide maximum flexibility to find and attract new businesses to the Shopping Center now occupied by Target. Only the voters can change the zoning at Cochrane Plaza. Your YES vote will help keep the Cochrane Plaza Shopping Center a vital commercial center.
