Shall the Crockett Reorganization, comprised of the formation of the Crockett Community Services District and dissolution of the Crockett-Valona Sanitary District, dissolution of County Service Area P-1, and dissolution of County Sanitation District No. 5 (Port Costa), be approved subject to the terms and conditions in the LAFCO resolution of approval upon an affirmative vote by a majority of those voting within the territory shown in Exhibit A?
This measure would create the Crockett Community Services District (CSD) and dissolve the Crockett-Valona Sanitary District, County Sanitation District No. 5 (Port Costa) and County Service Area (CSA) P-1. California law requires that creation of a CSD be approved by a majority of the voters of the proposed district. If approved by the voters, formation of the CSD and dissolutions of the Crockett-Valona Sanitary District and CSA P-1 will be effective as soon as practicable following the election. Dissolution of County Sanitation District No. 5 (Port Costa) will not become effective until the Regional Water Quality Control Board confirms that the wastewater treatment facility improvements delineated in the Time Schedule Order dated October 19, 2005 are completed and final payment to the contractor is made, as described in the LAFCO Resolution, a copy of which is enclosed with the ballot materials. The new CSD will be governed by a five-member board of directors elected at large. The voters, when deciding whether to form the district, will elect the initial governing board. The terms of office shall be for four years, except that the two members of the initial board who receive the fewest number of votes will serve two-year terms. The board will govern the district and make decisions about its budget operations and levels of service. The proposed reorganization is subject to the terms and conditions in the LAFCO Resolution. These terms and conditions authorize the new district to collect, treat and dispose of sewage and storm water; provide public recreation, including parks, playgrounds, swimming pools, community buildings and landscape maintenance; finance street lighting; abate graffiti and acquire and construct library buildings in cooperation with agencies providing library services. The property taxes, special taxes and other revenues that are currently allocated to the districts being dissolved will be transferred to and become revenues of the new district. No new tax or fee increases are proposed or authorized in conjunction with the proposed reorganization. If the CSD is formed, assets and liabilities, including the Crockett Community Center, will be transferred from Contra Costa County to the new agency. Other public services, such as law enforcement, fire protection, schools, health care, social services and the court system, will not be affected by the formation of the new CSD. The Crockett-Valona Sanitary District initiated this proposal by submitting an application to LAFCO. After analyzing the proposal, and numerous public hearings, LAFCO amended and approved the proposed reorganization. The proposed boundary is 686+ acres and consists of the Crockett-Valona Sanitary District and County Sanitation District No. 5 (Port Costa) plus an additional 25 parcels adjacent to the northern and western boundaries of the Crockett-Valona Sanitary District. Your YES vote is needed to protect existing community facilities and recreation services that might otherwise be lost or eliminated.
With the passage of MEASURE D, both Crockett and Port Costa will be big winners! We will regain ownership of the historic Crockett Community Center and will insure it for the first time against loss. Alexander Park, the swimming pool, tennis & bocce courts will be quickly transferred from the Crockett Recreation Association to public ownership for protection. Our recreation facilities will be unified under comprehensive, local management to achieve cost savings, improve security, and qualify for new grant funding to keep them open. Advising the elected Board will be a Recreation Commission, comprised of the members of our P-1 Committee and Crockett Recreation Assn, and separate Sanitary Commissions, comprised of the board members of Crockett-Valona Sanitary District and the committee members of Port Costa's Sanitation District #5. More cost-effective management than we now have under County control will greatly benefit both Crockett and Port Costa This plan includes no new hires or increased payroll. There is no tax increase in MEASURE D! With greater local control, existing services will continue with existing revenues. A two-thirds voter majority is still required for any increase in the existing recreation assessment. New state grant funding will be available, such as the $220,000 that would have come to Crockett Community Services District in 2002. Instead we got nothing! The finances of the Port Costa Sanitary Dept. and Crockett Sanitary Dept. will be kept entirely separate. Neither town will subsidize the other. Letters of support have been received from the P-1 Committee, Crockett Recreation Assn, Crockett Community Foundation, Crockett Chamber of Commerce, Crockett-Carquinez Fire Dept and Crockett Improvement Assn. RESOLUTION NO. 04-22
RESOLUTION OF THE LOCAL AGENCY FORMATION COMMISSION OF THE COUNTY OF CONTRA COSTA MAKING DETERMINATIONS AND APPROVING THE CROCKETT REORGANIZATION: FORMATION OF THE CROCKETT COMMUNITY SERVICES DISTRICT/DISSOLUTION OF THE CROCKETT-VALONA SANITARY DISTRICT/DISSOLUTION OF COUNTY SANITATION DISTRICT NO. 5/
DISSOLUTION OF COUNTY SERVICE AREA NO. P-1
WHEREAS, the above-referenced proposal has been filed with the Executive Officer of the Contra Costa Local Agency Formation Commission pursuant to the Cortese-Knox-Hertzberg Local Government Reorganization Act (Section 56000 et seq. of the Government Code); and
WHEREAS, at the times and in the manner required by law the Executive Officer has given notice of the Commission's consideration of the proposal; and
WHEREAS, the Commission heard, discussed and considered all oral and written testimony related to the proposal including, but not limited to, the Executive Officer's report and recommendation, the environmental document or determination, Spheres of Influence and applicable General and Specific Plans; and
WHEREAS, the Local Agency Formation Commission determines the proposal to be in the best interests of the affected area and the total organization of local governmental agencies within Contra Costa County.
NOW, THEREFORE, the Local Agency Formation Commission of the County of Contra Costa DOES HEREBY RESOLVE DETERMINE AND ORDER as follows: 1. The Commission certifies it reviewed and considered the information contained in the Negative Declaration prepared by the Crockett-Valona Sanitary District for the formation of the Community Services District and dissolution of the Sanitary District. 2. The Commission finds the remainder of the reorganization to be categorically exempt from CEQA. 3. Said reorganization is hereby approved. 4. The subject proposal is assigned the distinctive short-form designation: CROCKETT REORGANIZATION: FORMATION OF THE CROCKETT COMMUNITY SERVICES DISTRICT/DISSOLUTION OF THE CROCKETT-VALONA SANITARY DISTRICT/DISSOLUTION OF COUNTY SANITATION DISTRICT NO. 5/DISSOLUTION OF COUNTY SERVICE AREA NO. P-1 5. Said territory is found to be inhabited. 6. The boundaries of the affected territory are found to be definite and certain as approved and set forth in Exhibit A, attached hereto and made a part hereof. 7. The proposal is subject to the following terms and conditions: A. The new agency shall be the Crockett Community Services District B. Effective dates 1. The effective date of the following components of the reorganization shall be as soon as practicable following an election wherein the majority of registered voters approve the reorganization:

All assets and liabilities, physical and personal, monies or funds, including cash on hand and monies due but uncollected of County Service Area P-1, for recreation and park purposes held in or to be allocated to Fund 265100, shall be transferred to and become the assets and liabilities of the Crockett Community Services District.
3. Fee ownership of the Crockett Community Center and the underlying assessor parcel (APN 354-103-025-4) shall be transferred to and become the assets of the Crockett Community Services District provided that
a. The District is accepting the property and facility "as is"
b. The transfer includes all assets and liabilities associated with the Community Center
c. Prior to the transfer of these assets the District shall reimburse the County for all fees and costs, including staff time, associated with the formation of the Community Services District and the transfer of property to the new district.
J. On the effective date of the dissolution of County Sanitation District No. 5, or as soon thereafter as practicable:
