5 of the 9 Justices on the U.S. Supreme Court are over 65! The Presidential candidate elected in 2004 is likely to get to replace some or all of these five justices. Even ONE or two more Republican appointments could cost Americans their civil liberties, since many of the high court's decisions in such areas as reproductive rights, affirmative action, and gay and lesbian rights have been decided on 5-4 or 6-3 votes!

• Casey vs. Planned Parenthood - reaffirming women's consitutional right to have abortions - 5-4 VOTE

• Stenberg vs. Carhart - overturning ban on "partial birth" abortions - 5-4 VOTE

• Roemer vs. Evans - overturning state constitutional provision which prohibited adoption of legislation to protect the civil rights of gays and lesbians - 6-3 VOTE

• Lawrence vs. Texas - invalidating state law which criminalized gay sex between consenting adults - 6-3 VOTE

• Grutter vs. Bollinger - upholding affirmative action programs - 5-4 VOTE

Read, the following quotes from a 2/11/04 AP wire story, in which Scalia indicates he will vote on a case PERSONALLY involving his friend and hunting partner, Vice President Dick Cheney - with whom he just went on a hunting trip three weeks ago!

How can a judge fairly decide cases involving PERSONAL friends?

"Supreme Court Justice Antonin Scalia strongly indicated he will ignore calls to recuse himself from a court case involving his friend and hunting partner, Vice President Dick Cheney.

"Scalia told a gathering at Amherst College on Tuesday night there was nothing improper about his accompanying Cheney to Louisiana last month to hunt ducks. The trip came three weeks after the Supreme Court agreed to hear the Bush administration's appeal in a case involving private meetings of Cheney's energy task force. . . .

"Cheney wants to keep private the details of closed-door White House strategy sessions that produced the administration's energy policy. The administration is fighting a lawsuit brought by watchdog and environmental groups that contend that industry executives helped shape the administration's energy policy.

"Democrats in Congress, some legal ethicists and dozens of newspaper editorials have called on Scalia to stay out of the case. None of the groups in the case has formally asked Scalia to recuse himself, though the Sierra Club has said it might.

"Supreme Court justices, unlike judges on other courts, decide for themselves if they have conflicts, and their decisions are final. . . .

"Chief Justice William H. Rehnquist had rebuffed Senate Democratic leaders last month who questioned the trip, saying that justices strive to follow federal laws that require judges to stay out of cases in which their impartiality might be questioned. . . ."
