IMPARTIAL ANALYSIS OF MEASURE H Prepared by the City Attorney

AMENDMENT TO THE STOCKTON CITY CHARTER TO PROVIDE FOR THE DESIGNATION OF UTILITY USER TAX REVENUE FOR POLICE AND FIRE EXPENDITURES

The Stockton City Council, on its own motion, has placed this Measure on the March 4, 2003, ballot, to amend the Stockton City Charter to provide that the proceeds of the City's telecommunication, gas, electricity, water, video services user tax (UUT) be budgeted, appropriated and used exclusively for police and fire expenditures.

This Measure would not result in any increase in the existing tax; does not impose a new tax; not does it expand or change the application of the tax. This measure would provide a mandatory implementation mechanism with respect to the revenue generated from the UUT that the City Manager and City Council would be required to adhere to in the adoption of the City's budget and the appropriation of funds connected therewith.

Approval of this Measure would create a fixed revenue stream for public safety purposes that could not be reduced, absent a vote of the electorate.

A majority vote of the electorate is required for the adoption of a Charter amendment. Upon approval of the election results by the Council and upon filing of the Charter amendment and election results with the Secretary of State, this Measure would become effective July 1, 2003.

Arguments For Measure H
ARGUMENT IN FAVOR OF MEASURE H

Your YES vote for Measure H will ensure a reliable source of funding for police and fire services. Measure H dedicates all revenue from the Utility Users Tax, the most important source of General Fund revenue, to police and fire services, guaranteeing a baseline level of revenue the police and fire departments can count on every year.

This is an EXISTING TAX and NO INCREASE in the tax is involved. As Stockton's economy grows, the yield from the existing tax rate will grow and will be available only for police and fire. Support your police and fire departments! Help ensure adequate levels of police and fire services by voting YES on H!
