Government Code Section 36509 provides the alternative language which should appear on the ballots for such a question. In that the City Treasurer's position is an elective position, a person appointed to the position must be a resident of the City of Waterford. If the position was appointed, the City Council would not be limited to the geographical limits of the City of Waterford to find qualified applicants.

Government Code Section 36510 provides that, if a majority of the votes cast are in favor, the City Council shall appoint the officer at the expiration of the term of the officer then in office. The Waterford City Council is desirous of having the finance officer appointed to ensure the position is occupied and to ensure some functional abilities and experience in said public official.
